Newburgh man sentenced to 13 years in prison for criminal possession of a weapon

ORANGE COUNTY, N.Y. — Prosecutors believe a stiff sentence for a Newburgh man will send a message to “dangerous criminals who illegally possess and use dangerous firearms.”

Orange County District Attorney David M. Hoovler announced that Rudolph Davis, 31, of Newburgh, was sentenced Thursday in Orange County Court to 13 years in prison followed by five years of post-release supervision following his conviction in July for second-degree criminal possession of a weapon after a jury trial.

According to court documents, at approximately 1:05 a.m. on November 5, 2023, officers with the City of Montgomery Police Department responded to a report of a person threatening others with a weapon in the Village of Maybrook. Police found a van matching the description in the complaint on the way from the scene.

When officers stopped the vehicle, they discovered it was being driven by a woman, who was separately charged, with Davis as a passenger. During a search of the vehicle, police located a loaded 9mm handgun in the center console. Davis had additional cartridges matching the gun in his bag, which also matched cartridges located at the scene of the original incident.

“Dangerous criminals who illegally possess and use dangerous firearms must be held accountable,” Hoovler said. “All too often we see wanton violence through the use of illegally owned weapons. My office, along with our law enforcement partners, remains steadfast in our commitment to prosecuting illegally possessed firearms and the perpetrators who use them. Our community demands and deserves nothing less than this unwavering commitment.”

The district attorney thanked the Montgomery City Police Department for its investigation that led to Davis’ arrest. District Attorney Hoovler, the Orange County Sheriff’s Office and the New York State Police for their assistance.
