Crown is withdrawing murder charges against one of three defendants in the Moncton stabbing case

This week, murder charges were withdrawn against one of three people in connection with a fatal stabbing in Moncton.

Dana Livingston Mundell of Fredericton was charged with second-degree murder. He was accused of killing 32-year-old Kyla LaPointe on July 11, 2023 in Moncton.

That charge was withdrawn by a Crown prosecutor during an appearance in the Court of King’s Bench in Moncton on Wednesday.

“After several months of deliberation, the Crown concluded that there was no longer a reasonable prospect of convicting Mr. Mundell on the evidence necessary to convict him,” TJ Burke, Mundell’s defense lawyer, said in a statement to Radio-Canada.

“Mr. Mundell is happy with this outcome and wants to move forward with his life by putting this whole matter behind him.”

Mundell had been in custody awaiting trial since his arrest 15 months ago.

Dylan Alexander Jackson of Doaktown and Megan Marten of Fredericton still face second-degree murder charges in the case. They are scheduled to be tried by a jury from March 24 to April 11, 2025.

RCMP said last year that around 2:45 a.m. on July 11, 2023, police responded to a report of a disturbance on Belleview Avenue. Officers found LaPointe with multiple stab wounds. She died in hospital.
