A Richmond resident will receive 5,000 in compensation after a car accident

A Richmond resident has been awarded nearly $206,000 for a 2019 car accident.

Bashir Tootakhil was hit by a Richmond Cab in February 2019. Tootakhil was 43 years old at the time, married and had three children.

He worked as a taxi and Uber driver, but in the past he also worked for the US military as an interpreter and as an electronics technician.

At trial, Tootakhil claimed that after the accident he suffered constant back pain, which affected how much he could lift and sit, and that he had a “bad mood and personality change,” Judge Sheila Tucker said in her ruling.

In her summary, Tucker noted that Tootakhil’s primary limitations were due to spinal movements and weight-bearing activities that affected his ability to lift and stand upright for more than 30 minutes at a time. She also discovered that taking a taxi or Uber would worsen his lower back pain.

Additionally, she noted that Tootakhil suffered from low mood and a personality change after the accident.

However, Tucker also noted that Tootakhil should be able to drive an Uber for about eight hours a day with breaks, and that this has been possible since early 2022.

She also agreed with Tootahkil’s chronic pain doctor that as strength continues to build, he will “likely experience even more symptomatic improvement, particularly with regard to pain with lifting.”

Tootakhil received $90,000 for pain and suffering, approximately $11,500 for past loss of income, $52,000 for future loss of income and nearly $43,000 for future care costs. He was also awarded $7,500 for loss of housekeeping ability and more than $2,000 in special damages totaling $2,098.
