The family of a third accuser is suing a man on trial accused of groping two pediatric dental patients in Chandler and the dentists who employed him.

According to court records, 28-year-old Deion Alexander Garcia of Mesa is scheduled to be arraigned Jan. 16 on suspicion of 14 counts of child abuse. Charging documents indicate that Garcia was a dental assistant when he committed these crimes on two girls, 4 and 6, on May 8 and 9 while working at Kidiatric Dental & Orthodontics.

The lawsuit was filed Tuesday by the parents of a girl who, according to criminal court records, said as a 6-year-old that Garcia touched her genitals on Sept. 9, 2022, while taking X-rays of her at the Chandler Heights location. However, according to criminal court records, Chandler police dropped the case due to lack of evidence.

The lawsuit says the girl “suffered severe emotional distress and mental anguish” and seeks compensatory damages, which must be proven in court, as well as punitive damages for an alleged sexual assault. The lawsuit alleges that the X-ray room was unsafe for children due to a lack of surveillance cameras, the dentistry should have known he may have engaged in misconduct, and the company failed to stop him from doing so.

The lawsuit’s allegations include that a dental doctor created a confrontational situation between Garcia and the girl and her mother because of the allegations, and that he cross-examined the girl instead of calling the police.

When Garcia was arrested on May 10, he had been working in dentistry for two and a half years, according to charging documents.

Kidiatric’s lawyers could not be reached for comment on Thursday. The office declined to comment on the lawsuit.
