A judge in Georgia late Tuesday blocked a new rule requiring a hand count of ballots on election night, dealing another blow to Republican election officials in the state – many of whom incorrectly blame voter fraud for Donald Trump’s loss in the state in 2020 Hours after the same judge issued another ruling requiring local officials to certify the election results.

In his ruling, Georgia Supreme Court Justice Robert McBurney said the hand counting rule was “too much, too late” because he had stopped enforcing it while the court “considers the merits” of the case.

Last month, the GOP-controlled Georgia State Board of Elections adopted a new rule requiring three election workers to count ballots, but not votes, in each county on election night, after polls close and before a machine count.

The judge said the new rule was adopted too close to Election Day and noted that a county’s election budget did not include training or funding for “additional staff and other expenses” needed to conduct the hand count.

McBurney wrote that the election board “may be right” in believing that hand counting is a wise electoral policy and “provides confirmation by the human eye that the machine’s counts are consistent with reality,” but criticized the timing his farewell.

During the hearing, the election board’s attorney had argued that the hand count would take just a few extra minutes instead of hours.

“The administrative chaos that will – and does not have to – ensue is in complete contradiction to the obligations of our electoral boards (and the SEB) to ensure that our elections are fair, lawful and orderly,” McBurney wrote in his ruling.

How did the Democrats react to the ruling?

The Harris campaign and other Democratic groups issued a joint statement welcoming Tuesday’s ruling: “From the beginning, this rule was an attempt to delay the election results in order to sow doubt about the outcome, and our democracy is grateful.” This decision to block it is stronger.” Democratic elections lawyer Marc Elias said on X that the ruling was the “second victory today against election subversion in Georgia!”
