CCLA will be before the Supreme Court today in IM v. R appear for juvenile justice

The CCLA will appear as an intervener in the Supreme Court of Canada today IN v. R.. This appeal concerns the test for sentencing a young offender as an adult under the Juvenile Justice Act.

Shakir Rahim, Director of the Criminal Justice Program, issued the following statement:

“The Juvenile Justice Act protects youth in the criminal justice system, values ​​their rehabilitation and gives them a second chance. The CCLA will argue in the Supreme Court today that sentencing courts must set out and take into account two important principles when considering sentencing a young person as an adult.

First, young people are always entitled to the presumption of diminished moral culpability, which must be rebutted at a high level in order to convict a young person as an adult. Second, any factor relied upon by the prosecution to support an adult sentence must be proven beyond a reasonable doubt.

These principles are essential to protect the rights of young people in criminal proceedings.”
