Charlie Miller and Haris Mujezinovic file class action lawsuit against IU over sexual abuse by former team doctor – Inside the Hall

Former Indiana University basketball players Charlie Miller and Haris Mujezinovic today filed a class action lawsuit against the university alleging sexual abuse by a former team doctor.

The lawsuit, filed Tuesday in federal court in Indianapolis, alleges that Miller and Mujezinovic “were murdered by Dr. Bradford Bomba Sr., the team’s physician, was routinely and repeatedly subjected to medically unnecessary, invasive and sexually abusive rectal exams.”

Bomba Sr. served as a contract physician for IU athletic teams, including the men’s basketball program, for several decades until he began his practice in the late 1990s.

Miller played 126 games for the Hoosiers from 1994 to 1998. Mujezinovic played 62 games from 1995 to 1997.

“I will never understand why IU leadership did nothing to protect us from sexual abuse,” Miller said in a statement from DeLaney & DeLaney, an Indianapolis-based law firm that filed the lawsuit.

The lawsuit accuses IU of “knowing of the abuse and failing to act on that knowledge by addressing players’ complaints about Dr. Bomba Sr. systematically mishandled or turned a blind eye to what violated federal law.”

The 22-page lawsuit also alleges that “IU’s failure to take effective preventative measures resulted in the persistence of this sexually abusive behavior, the harm to students, and the establishment of a policy of deliberate indifference toward and tacit acceptance of Dr . Bomba’s sexual assaults.”

The lawsuit seeks “undetermined monetary damages on behalf of all former IU student-athletes who were injured by Dr. Bradford Bomba Sr. was sexually abused.”

In September, Indiana University announced that it had hired Jones Day to launch an independent investigation into allegations against Bomba Sr. made by a former IU men’s basketball student-athlete.

According to IU’s September statement, the review will include witness interviews, a review of available documentation and collaboration with medical experts to determine: 1) the background information related to the annual physical examinations of IU student-athletes conducted by Dr. Bomba, Sr. ; 2) whether the conduct was appropriate, necessary or within the scope of the duty of care; and 3) which medical professionals and athletic department or university officials knew about the conduct and, if warranted, what action they took.

The university said it would abide by the findings of the review and “take all appropriate action.” The university’s September statement also said IU would have no further comment while the review is ongoing.
