Rochester man charged with sexual assault of minor – Post Bulletin

ROCHESTER – Olmsted County officials arrested a Rochester man Friday after investigating reports of a minor who sexually assaulted him multiple times.

Levi Michael Vivier, 43, is charged in Goodhue County District Court with second-degree criminal sexual conduct involving a minor, fourth-degree criminal sexual conduct involving sexual contact with a minor and disseminating sexual material involving sexual conduct with a child or describes , all crime. He was also charged with the gross misdemeanor of indecent exposure in the presence of a minor.

Vivier is also charged in Olmsted County with four counts of first-degree criminal sexual conduct, including penetration, penetration with a dangerous weapon and penetration of a minor. He is also accused of manipulating a witness. All charges in Olmsted County District Court are felonies.

Vivier was scheduled to make his first appearance in Olmsted County District Court on Monday, October 14th.

According to the Goodhue County criminal complaint, a Goodhue County sheriff’s deputy spoke with an assigned reporter on May 18. The assigned reporter said a 15-year-old girl was sexually abused by Vivier in February. The alleged attack occurred in a vehicle at a location between Goodhue and Red Wing.

According to the complaint, officers interviewed the 15-year-old on May 21. The girl told the officer that on February 13, she left school early and went to a local gas station with her friend. On their way out, they noticed Vivier in a truck in the parking lot. Vivier drove her back to her friend’s house.

The 15-year-old said when they arrived at her friend’s house, they remained in the truck for a few minutes until Vivier reached back to touch the girl, the complaint states. While he was touching her, he continued talking to her friend. Vivier then asked her to “get out of his truck because it would look bad if someone saw two teenage girls in his truck with him,” the complaint states.

After the incident, Vivier added the girl on Snapchat, the complaint says. He began messaging her and sending her photos of his genitals, the complaint says. The girl told officers that he would get angry if she didn’t answer his messages and that he would send “threatening messages about attacking her.”

According to the Goodhue County complaint, the girl said she was afraid of Vivier. She said she just wanted to document the measures and not move forward.

On August 6, the girl’s mother contacted authorities and said they wanted to continue the investigation.

Another minor, a 14-year-old girl, reported that Vivier added her on Snapchat to ask about the 15-year-old. He then asked her to send nude pictures.

The 15-year-old’s friend, who was in the truck with her, said she didn’t know what Vivier was reaching for while they were in the truck. She said he had previously sent her pictures of his genitals and sent her sexual messages.

Vivier was arrested and interviewed by Olmsted County detectives on Oct. 11. He admitted sending photos and videos of himself to the 15-year-old, but said he thought she was 19, the complaint says.

According to the Olmsted County criminal complaint, a 15-year-old reported being attacked by Vivier several times beginning in February. She told officers that the first assault occurred in northeast Rochester, near Vivier’s residence, when the girl was 14, the complaint says. While attacking her, he displayed a gun and told her, “He would shoot her if she told anyone anything about the attack,” the Olmsted County complaint states.

According to the Olmsted County complaint, the last alleged assault occurred on Aug. 15. She estimated that Vivier attacked her 10 times, “but they ‘blurred’ together,” the complaint said. She said Vivier would tell her he would shoot and kill her if she told anyone about the assaults or “did not comply with his demands.” He told her, “He would dump her body on an Indian reservation and she would never be found,” the complaint states. She told police he described how he would “bury her body in such a way that animal bones would prevent anyone from finding her remains.”
