Thane MACT awards ₹76.3 lakh to family in fatal car accident between Pune and Mumbai, ET LegalWorld

The Motor Accident Claims Tribunal (MACT) in Thane awarded Rs 76.3 lakh compensation to the family of a 39-year-old man who died in a car accident on the Pune-Mumbai Expressway in February 2020.

The order was delivered last week by SB Agrawal, chairman of MACT Thane. The plaintiffs are the widow, two minor children and the mother of the deceased against the car owner and the insurance company.

According to court documents, the fatal accident occurred on February 22, 2020, when the deceased was traveling in a car that crashed into the wall of a tunnel on the highway. The court found that the accident was caused by the driver’s rash and negligent driving. Kusam, who was 39 at the time of his death, worked for a financial services company and earned a monthly salary of Rs 40,000.

The court used this as a basis for calculating compensation, taking into account future prospects, loss of income and other considerations. The compensation amount must be paid jointly by the vehicle owner and the insurance company.

The court ordered that parts of the compensation be deposited in fixed deposits for the benefit of the deceased’s family members and that certain amounts be allocated to the widow, children and mother.

The arbitral tribunal noted in its decision that the plaintiffs’ evidence, in particular the police files, showed that the accident was caused by the negligence of the driver of the other party’s vehicle. As for the insurer’s claim, there is no evidence that the driver of the vehicle in question did not have a valid driver’s license or driver’s license or violated the terms of the contract. Therefore, the defendants are obliged to pay compensation to the plaintiffs.
