Trump argues special counsel’s evidence in federal election case should not be released before Election Day – NBC Los Angeles

Donald Trump’s lawyers spoke out on Thursday against the release of additional evidence in the former president’s case of interference in the federal election in the run-up to Election Day.

“There should be no further disclosures at this time of the so-called ‘evidence’ that the Office of Special Counsel unlawfully selected and misrepresented during early voting in the 2024 presidential election in connection with an improper request for presidential immunity. “There is no basis in a criminal case or precedent,” Trump’s lawyers wrote.

“If the Court decides to release additional information related to the Office filing in the appendix or otherwise, President Trump respectfully requests that the Court stay that decision for a reasonable period of time to allow President Trump to pursue litigation related to the decision can check.” ” The submission continued.

After former President Donald Trump attacked the Biden administration’s crime and immigration record, Vice President Kamala Harris detailed Trump’s ongoing legal battles. “I think that’s so rich for someone who has been prosecuted for national security crimes, white collar crimes, election interference, convicted of sexual assault, and whose next big court date is in November when his own criminal sentence is announced.”

The additional evidence comes in connection with a 165-page brief that Smith’s team released earlier this month. It alleges that Trump “committed crimes” to stay in office after his election defeat four years ago and argues that his actions at the time did not involve official behavior as Trump’s team has argued.

A spokesman for the special counsel’s office declined to comment on the filing.

Prosecutors from Smith’s office had previously rejected claims from Trump’s lawyers that the administration was “motivated by improper political considerations.”

“The special counsel’s mission is to uphold the law. He has no role or interest in partisan politics and has diligently discharged his prosecutorial duties in this case,” they wrote in an Oct. 1 filing.

Trump and his lawyers have repeatedly tried to delay trials on the charges he faces until after next month’s election.

The federal election case was turned on its head after the Supreme Court’s immunity ruling, which found that Trump enjoyed some protection from prosecution related to official acts. No trial date has been set.

The charges against Trump in Georgia, which are also related to efforts to overturn the 2020 election results, will not go to trial until November. The judge overseeing the case last month threw out three of the original 41 charges, including two against Trump.

Regardless, Trump successfully postponed the announcement of his hush money trial in New York. A judge overseeing the case last month granted the former president’s request to delay the sentencing hearing again until after Election Day. A jury convicted the former president in a hush-money case on 34 counts of falsifying business documents in connection with a payment to an adult film star in the run-up to the 2016 presidential election.

The sentencing, now scheduled for November 26th, has been repeatedly postponed from the original date of July 11th.
