Chicago prosecutors are declining to charge a “dangerous” Colombian migrant in the shooting death of a 17-year-old

Cook County State’s Attorney Kim Foxx declined to file charges against a “dangerous” Colombian migrant arrested on murder charges in Chicago last week.

Foxx’s decision comes after a CPD source told Fox News that the migrant’s illegally purchased gun exploded in an apartment building, killing a “beautiful and promising” 17-year-old girl.

A Chicago police source told Fox News that 19-year-old Juan David Ramirez-Olivo lied about being from Venezuela when he was arrested for murder and questioned by CPD last week. Ramirez-Olivo is a Colombian citizen.

An Immigration and Customs Enforcement source told Fox News that Ramirez-Olivo previously entered the United States under the parole program and was given a notice to appear.

ICE told Fox News that Ramirez-Olivo was arrested last Thursday after being arrested on first-degree murder charges and taken into custody on Saturday.

Chicago police pushed to charge Olivo with involuntary manslaughter; Foxx’s office went to bail court last Friday afternoon and quashed the charges, citing “insufficient evidence” to Fox News.

According to a CPD source, a police chief assigned to the case was unhappy with Foxx’s decision and pushed for Olivo to be charged.

“If you want to say it was a complete accident and it wasn’t reckless, then charge him minimally for the gun, which he admittedly bought illegally,” the CPD source told Fox News. “Nobody thinks it’s legal to buy a gun from a man on the street. Besides, he shouldn’t even have a gun.”

Ramirez-Olivo was in an apartment with 17-year-old Stephanie Lopez Ramirez on Tuesday, Oct. 1, when his illegally purchased gun went off, hitting Stephanie in the arm and killing her, according to a CPD source.

A family friend of Ramirez said, “She was a very sweet girl who loved her family very much. Always happy and full of life.”

Chicago police confirmed that a female victim was found unresponsive at a residence with a gunshot wound to her left arm. Ramirez was pronounced dead at the scene and a person of interest was in custody.

Ramirez-Olivo claimed it was an accidental shooting, but Chicago police sources and a friend of the victim’s family question that claim.

“After a thorough review of the information provided to us by police, we concluded that the totality of the evidence was insufficient to meet our burden of proof to file criminal charges,” Kimm Foxx’s office wrote in a statement to Fox News. “As prosecutors, we have both an ethical and legal obligation to make charging decisions based on the law and evidence. We remain open to further review if new or additional information is presented to us.”

Police records show Ramirez-Olivo was arrested in Chicago in March on a charge of possession of a deadly weapon, a knife, on the street. He was also accused of previously stabbing someone.

Cook County State’s Attorney Kim Foxx’s office did not immediately respond to Fox News Digital’s request for additional comment.
