No criminal charges have been filed against the Salina teacher accused of sitting on the student

WICHITA, Kan. (KWCH) – Salina police said no charges will be filed against a The Salina South Middle School teacher was sitting on top of a student who had just finished training.

Police said shortly after the incident, the 13-year-old student fainted, rolled off the bench and hit his head on a bench, resulting in a cut to his head.

Police said investigators have completed interviews and forwarded the case to Salina Municipal Court, which has asked the Saline County Prosecutor’s Office to review the case.

“The Saline District Attorney declined to prosecute, citing all witness statements indicating that, in his opinion, the threshold for filing criminal charges was not met,” police said. “The district attorney concluded, based on the prevailing opinions of the witnesses, that most believed the incident was a joke. “Therefore, they could not prove criminal intent.”

Salina Public Schools said the teacher has been placed on leave pending the investigation. It is unknown if he is back at school.
