Uncle and nephew imprisoned for sexually harassing a relative

KOTA KINABALU (Oct 7): A man and his nephew were sentenced to 10 years in prison for physically sexually assaulting their minor relative and sentenced to three strokes of the cane by a sessions court.

The uncle, who worked as a burger seller, and his unemployed nephew pleaded guilty on Monday before Judge Amir Shah Amir Hassan.

The 51-year-old uncle had committed the offense against his 15-year-old niece by fondling her breasts and sucking her private parts at a house in a village in Papar in April 2023.

Meanwhile, the 31-year-old nephew had sexually assaulted the same victim, who is his cousin, when she was 16 years old by fondling her breasts and inserting his index finger into her private area.

The crime was committed in July at the same location.

Her charges were under Section 14(a) of the Sexual Offenses Against Children Act 2017.

The section provides for a prison sentence of up to 20 years and flogging upon conviction.

The court ordered them to serve their sentences from the day of their arrest and ordered that they be placed under police supervision for three years after their sentences expire.
