Delhi court initiates FIR against former employees of fashion designer for criminal breach of trust

New Delhi: The Delhi Saket dish on Friday led the Delhi Police to register an FIR against two former employees of an eminent fashion designer Pallavi Mohan for criminal breach of trust.

“This court has no hesitation in holding that the cognizable offense of criminal breach of trust by a servant is punishable by us. 408 IPC is clearly being committed by the suspects Manu Uniyal and Surender Kumar,” said first class magistrate Akshay Sharma while directing the station house officer Okhla industrial area Police station to register an FIR.

Mohan, owner of the brand ‘Not So Serious’, had filed a complaint alleging that her former employees Uniyal and Kumar, during her employment, took orders of women’s clothing from her customers and supplied them with clothes under her brand name.

The court also noted that proper investigation is required in this case as the sellers and buyers also need to be investigated.

While perusing the action report filed by the Delhi Police, the court observed that no trademark infringement was found during the investigation.

However, the court ordered that the investigation can be postponed if a violation of trademark law comes to light during the investigation.

The court has asked for a compliance report to be filed on October 18.

She also alleged that the duo illegally manufactured clothes using Mohan’s designs and other resources and sold them under her brand name while taking payments and redirecting them to her relatives’ accounts.

Mohan also pointed out that she had also lodged a complaint with the Delhi Police but no action was taken. As a result, she filed a complaint in the court through lawyers Sumit Gehlot and Nikhil Bhalla seeking directions to the Delhi Police to register the FIR in the case.
