A US judge has made an important decision in the ongoing legal saga surrounding the attack Netflix show Baby reindeer.

The Emmy-winning miniseries was inspired by its creator and star Richard Gaddis the true experience of Stalking, with each episode beginning with a message that reads, “This is a true story.”

Earlier this year, a woman who claimed she inspired the stalker character “Martha” took legal action against Netflix, accusing the platform of “defamation, intentional infliction of emotional distress, negligence, gross negligence” and “violations of.” [her] Right to privacy.”

At the time, she was seeking $170 million (around £127 million) in damages.

On Friday, U.S. District Judge Gary Klausner ruled that the woman in question can proceed with parts of her lawsuit, claiming that the opening message that the show was “a true story” led viewers to believe that “Baby Reindeer” was completely factual be.

And while the judge said the woman’s “alleged actions were reprehensible,” he said fictional character Martha’s behavior was “worse” and therefore she had a case.

“There is a big difference between stalking and being convicted of stalking,” he said.

“Similarly, there are big differences between inappropriate touching and sexual assault, and between poking and gouging another person in the eyes.”

“While Plaintiff’s alleged actions are reprehensible, Defendant’s statements are of a more serious magnitude and could produce a different effect on a viewer.”

Although the plaintiff may proceed with her claim for intentional infliction of emotional distress, her claims for negligence, violation of her publicity rights, and punitive damages were dismissed by the judge.

“It appears that a reasonable viewer could understand that the statements about Martha referred to the plaintiff,” he said.

“The series states that the plaintiff is a convicted criminal who sexually and violently assaulted Gadd. These statements can lead to extreme and outrageous behavior.”

Netflix had previously vowed to “vigorously defend this matter” and insisted they would also support “Richard Gadd’s right to tell his story.”

Richard also said in his own court filing in July that the series was “emotionally true” and was not intended as “a seamless retelling,” while also detailing the “stalking, harassment, abuse and threats” he alleged occurred between suffered by the plaintiff in 2014 and 2017.

Jessica Gunning — who recently won an Emmy for her portrayal of Martha in Baby Reindeer — also said in an interview that she believes Richard “has every right to tell his side of this story in an artistic, emotionally truthful way.”
