Delhi High Court directs the firm to accept new applications only under new criminal laws

The court took cognizance of the matter in a case in which a petition was filed under Section 482 of the then Code of Criminal Procedure (CrPC).

Notably, the CrPC has been replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 since July 1. Likewise, the Bharatiya Nyaya Sanhita has replaced the Indian Penal Code (IPC), while the Bharatiya Sakshya Adhinayam has replaced the Indian Evidence Act.

The court emphasized that these new laws must now be used in new files instead of the old criminal laws.

“This Court has taken a serious view… that reliance on the old criminal laws despite the introduction and implementation of new laws is a clear violation of the intent of Parliament and frustrates efforts for its effective implementation. Since the new laws “The applications filed after July 1, 2024 have already been implemented on July 1, 2024 and published in the Gazette notification of the Union of India. No court can decide on applications submitted after July 1, 2024 under the old laws because they are no longer in force.” said the court.
