DEAR WEHO: Laws restricting sex clubs and bathhouses are outdated

The AIDS epidemic of the 1980s and 1990s caused a wave of fear and panic and led to the introduction of several laws and regulations to prevent the spread of the virus. These measures included closing bathhouses and sex clubs that were considered hotspots for risky sexual behavior.

However, as we continue to make progress in HIV prevention and treatment, it is time to reevaluate these laws and consider repealing them. The reality is that these facilities can play an important role in promoting safe sexual practices and providing vital resources for the LGBTQ+ community.

First and foremost, bathhouses and sex clubs can be a valuable resource for HIV education and prevention. These facilities can provide free condoms and safe sex education materials and offer on-site HIV testing. In doing so, they can help reduce the transmission of HIV and other sexually transmitted infections.

Additionally, bathhouses and sex clubs can also serve as a safe and inclusive space for the LGBTQ+ community. These establishments often cater to a predominantly queer audience and provide a sense of community and acceptance for individuals who may not feel comfortable in other public spaces. They also provide a space for sexual expression and exploration, which can be particularly important for those who may face discrimination or stigma in their daily lives.

By allowing these facilities to operate legally, cities can regulate and enforce safer practices. This includes requiring regular testing for sexually transmitted infections and mandating safe sex practices. These regulations can help individuals practice safe sex and minimize potential risks.

Repealing regulations that prevent new bathhouses and sex clubs from operating can also have economic benefits for cities. These businesses can generate income and create employment opportunities, which can be particularly important in today’s economic climate. Additionally, since the LGBTQ+ community represents an important consumer group, the acceptance of these establishments can attract tourism and boost local businesses.

It is important to note that the fears and stigmas of the AIDS era no longer reflect the reality of HIV today. Advances in treatment enable people living with HIV to live long and healthy lives, and the risk of transmission is significantly reduced through appropriate prevention methods. It is time for our laws and regulations to keep pace with this progress.

Closing bathhouses and sex clubs was a reactionary measure in a time of fear and uncertainty. It is time for cities to rethink these laws and recognize the positive impact these facilities can have on public health, LGBTQ+ communities and local economies. By lifting some of the outdated heavy-handed restrictions that prevent these safe spaces from existing here in Los Angeles and West Hollywood, we can create a more inclusive and progressive society.

We, the LGBTQ+ community, intend to petition and submit an official referendum to reform bathhouse and sex club laws and licenses to allow new businesses and safe spaces to return to our city.
