Schenectady man convicted of gun purchase in connection with shooting outside Temple

A Schenectady man who pleaded guilty in federal court to conspiring with the suspect accused of firing a shotgun on the steps outside Temple Israel in Albany in December has been sentenced.

According to the U.S. Attorney’s Office for the Northern District of New York (NDNY), 38-year-old Andrew Miller admitted to working with Mufid Fawaz Alkhader to illegally purchase a shotgun from him.

Miller must serve 14 months and three years of probation.

“Between October 1, 2023 and November 6, 2023, he and Alkhader conspired to lie to an Albany County gun dealer that he (Miller) was the actual purchaser of a Kel-Tec 12-gauge pump shotgun, when in fact Alkhader was the purchaser true buyers,” prosecutors said in a news release. “Miller and Alkhader came up with the plan because they believed Alkhader could not legally purchase the shotgun himself.”

Alkhader was charged in federal court in December in connection with the aforementioned incident. Police told CBS6 at the time that two shots were fired at the front steps of Temple Israel in Albany just before 2 p.m. Alkhader’s case is ongoing.

According to a press release, Miller also admitted that on November 5, 2023, he lied on the firearm transaction log submitted to the gun store and claimed that he was the true purchaser of the gun. Miller and Alkhader reportedly returned to the gun store the next day, where Miller is accused of taking possession of the gun but then transferring that possession to Alkhader.

Shortly after the shooting in December 2023, CBS6 spoke with a man who said he was Alkhader’s father. The man said his son had not lived at home for several years and was staying with friends in the Capital Region. He also said Alkhader suffered from mental health and drug problems.

According to the US Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), Alkhader was born in Iraq and is now a US citizen. Court documents said he waived his Miranda rights and told police at the time: “Events in the Middle East are affecting him.” The shooting occurred exactly two months after Hamas attacked Israel.
