According to an affidavit, three men are charged with murder in connection with shootings outside a basketball hall

SAN ANTONIO — Three men are charged with murder in connection with a deadly shooting outside a basketball arena in south San Antonio, according to an affidavit.

Diontay Roberson, 24, Justin Eaton, 25, and Glen McGarity, 41, are accused of shooting 27-year-old Xavier Perez.

The shooting occurred around 12:15 a.m. on April 26, 2024, in the 100 block of Topeka Boulevard near South Presa Street.

According to an affidavit, Perez’s brother told authorities that Eaton had contacted one of his family members several weeks before the shooting and threatened to kill him.

The affidavit also states that Perez’s brother said he believed the case was a case of mistaken identity because he had an ongoing feud with the suspects over drugs.

Perez and his brother played basketball in the gym where the shooting occurred at the same time every Thursday night for years, which the gym owner confirmed to authorities, the affidavit said.

Surveillance footage of the shooting showed a silver SUV arriving in front of the gym. The vehicle’s front and rear passengers began shooting at Perez, who fell to the ground, authorities said.

The rear passenger then exited the vehicle and shot Perez several times at close range, according to the affidavit. At the same time, authorities said the other passenger continued to fire at Perez.

After the shooting, authorities said all three suspects fled the scene in the SUV.

About eight hours after Perez’s death, the affidavit said a San Antonio police officer tipped off a GPS tracker to the officer investigating the case of a stolen silver Mitsubishi Outlander.

Authorities said the Mitsubishi Outlander at the time of the fatal April 26 shooting matched the vehicle in surveillance footage. The detective said the GPS tracker showed the suspects were at the scene before and after Perez’s death.

The detective gave the officer the names of the suspects, adding that they had been tracking them since February in connection with several robberies in the San Antonio area.

Shortly after Perez was shot, shots were reported a few blocks from Eaton’s girlfriend’s house, where the suspects had decided to take the stolen Mitsubishi Outlander, according to the affidavit. A ballistics report found a match to bullet casings from the shooting that killed Perez, authorities said.

According to authorities, Roberson and McGarity were arrested on May 7, 2024 in connection with an aggravated robbery. The affidavit states that they used the Mitsubishi Outlander during the robbery and attempted to set it on fire before being arrested.

According to the affidavit, Roberson and McGarity’s phones were confiscated when they were arrested in connection with the aggravated robbery. An examination of phone records revealed that the suspects arrived at the scene of Perez’s fatal shooting 20 minutes before the crime.

Authorities said they believe the suspects worked together to shoot Perez. As a result, Perez died from his injuries.
