HC rejects survivor’s request to investigate unauthorized access to memory card

The forensic investigation revealed that “the memory card is used in a mobile phone manufactured by Vivo with an Android operating system and a Jio network application. Telegram, WhatsApp and Instagram apps were installed on this device.”

The memory card was accessed on the night of January 9, 2018 to December 13, 2018 at 9:58 p.m. and 10:58 p.m. The third access took place on July 19, 2021, from 12:19 p.m. to 12:54 p.m.

The Supreme Court then directed the Ernakulam district and sessions judge to conduct a factual inquiry into the trespass allegations on April 12.

The district and sessions judge’s investigation revealed that three people, a former Angamaly court judge and two court employees, had accessed the memory card.

In the affidavit filed before the Supreme Court, the survivor, citing the inquiry report, claimed that Leena Rasheed, the then JFCM, Angamaly, Mahesh Mohan, senior clerk to the then principal and sessions judge, who is now a judge at the Kerala High Court, and Thajudeen , then Shirstadar of the Ernakulam court, had accessed it.
