Liability for accidents involving the Henrietta semi-trailer

Road construction sites remain very dangerous for workers. According to the National Safety Council, “In 2022, 891 people died and 37,701 people were injured in work zone accidents.” Workplace accidents are accidents that occur within the boundaries of a work zone or when approaching or leaving a work zone due to activities, behaviors or controls relating to traffic moving through the boundaries of a work zone.” There are a number of common causes of workplace accidents.

  • Driver distraction
  • Speeding
  • Improper signage
  • Bad road conditions
  • Inexperienced drivers

If a worker is killed or injured at work, he or his family is usually entitled to the workers’ compensation system. This system works through a no-fault insurance system. The family of a deceased or injured worker may also seek recourse through a third-party liability claim. A third-party liability claim may be possible if a company independent of an employee’s employer contributed to a collision. There can be numerous sources of third-party liability for any truck accident.

  • The company that owns or operates a commercial truck could be held responsible.
  • A general contractor could be held liable if a work area is in a dangerous condition.
  • A municipal entity could potentially be held liable for an accident if it was caused by a dangerous condition on public property.

After a truck accident, it can be difficult to know where to start. Many victims suffer life-changing injuries that impact their ability to return to work. If a worker is killed, his family may lose the income they need to pay all their bills. It is critical that accident victims and their families understand that they have rights in the event of a fatal workplace accident. The family members of a worker who died in a work area collision may be able to obtain some measure of justice through a civil lawsuit.
